Welcome to Cubby. These Terms of Service ("Terms") govern your use of the Cubby mobile application and services. By using Cubby, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Cubby, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our services.

2. Description of Service

Cubby is a daycare management platform that enables:

• Daycare staff to log daily activities for children
• Parents to view their child's activities and communicate with staff
• Management of child information, attendance, and documentation
• AI-assisted daily reports and natural language commands

3. Account Registration

To use Cubby, you must:

• Be at least 18 years old
• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

4. User Responsibilities

As a user, you agree to:

• Use the service only for lawful purposes
• Provide accurate information about children in your care
• Respect the privacy of other users
• Not share your account credentials with others
• Not attempt to access accounts or data belonging to others
• Not upload harmful, inappropriate, or illegal content

5. Daycare Responsibilities

Daycare operators using Cubby agree to:

• Obtain proper consent from parents before adding child information
• Ensure staff members are properly trained on data privacy
• Maintain accurate records of children and activities
• Comply with all applicable childcare regulations

6. Subscription and Payments

Cubby offers subscription plans with the following terms:

• Free Trial: 14-day free trial, no credit card required
• Monthly Plan: $39.99/month, billed monthly
• Annual Plan: $399/year, billed annually
• All payments are processed securely through Stripe
• You may cancel your subscription at any time
• Refunds are provided in accordance with our refund policy

7. Intellectual Property

Cubby and its content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our content without permission.

8. Data and Privacy

Your use of Cubby is also governed by our Privacy Policy. You retain ownership of the data you input into Cubby. We process your data in accordance with our Privacy Policy.

9. Limitation of Liability

Cubby is provided "as is" without warranties of any kind. We are not liable for:

• Interruptions or errors in service
• Loss of data (though we maintain backups)
• Actions taken by daycare staff or parents
• Indirect, incidental, or consequential damages

Our total liability is limited to the amount you paid for the service in the past 12 months.

10. Termination

We may suspend or terminate your account if you violate these Terms. You may terminate your account at any time by contacting support. Upon termination, your right to use the service will cease immediately.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the app. Continued use after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes will be resolved through binding arbitration.
